South Alabama Auto Auction is an auction service. South Alabama Auto Auction does not own the vehicles offered for sale: individuals and dealers own the vehicles. The following policies are followed to create a safe and equitable market for both buyers and sellers. The auction promotes these policies to ensure that all business is fair to both buyers and sellers. If the auction feels that a business transaction is unethical it may terminate the sale.
1. No one under the age of 16 will be admitted. Buyers must be 19 years old to bid.
2. Buyers must have a buyer badge worn visibly on their person. Badges are obtained by registering in the office.
3. All vehicles must have the proper Vehicle Identification Number (VIN) plate.
4. All taxis, police and commercial vehicles must be identified prior to sale.
5. All vehicles with prior or existing salvage titles must be identified at time of sale.
6. Bills of sale must be signed immediately by both buyer and seller following purchase of vehicle. A $200.00 CASH DEPOSIT IS TAKEN ON THE STAND FROM THE BUYER AT THE TIME OF PURCHASE.
7. "RIDE & DRIVE" vehicles must be test driven and/or arbitrated within one hour of purchase.
8. "AS IS" cars are not subject to arbitration unless there is either flood or frame damage. Cars sold for $1000.00 or less are sold "AS IS" and therefore, not subject to arbitration.
9. "RIDE & DRIVE" cars are represented by the seller (not South Alabama Auto Auction) to have a reasonably good motor and transmission considering age, mileage, condition, etc of the vehicle. Air conditioning, valve train noise, and/or any visible defects (smoking, dash cracked, etc.) are not covered under "RIDE & DRIVE."
10. Test drive vehicles on Wilcox road only next to the auction. Do Not test drive inside auction lot or on the interstate. All cars must have a gate pass before leaving premises and are subject to trunk inspection.
11. Buyer and seller agree to handle all complaints and rejections through arbitration on sale night only. THE DECISION OF THE AUCTION IS FINAL.
12. All buyers will be charged a buyer's fee (according to the schedule shown below) a title application fee (if applicable), and state and local tax when required by law.
13. All sellers will be charged seller's fee (according to the fee schedule which is subject to change without notice.) and a registration fee.
14. A registration fee will be charged to the seller for each sale in which the vehicle is run.
15. Payment is due immediately after purchase. CASH & PERSONAL CHECKS ACCEPTED WITH A 3 PERCENT FEE ON TOTAL PRICE OF VEHICLE.
16. Vehicle and title will not be released to buyer until payment in full is received. Clear title must be presented at the office before payment is disbursed to the seller.
17. If payment is not received, the sale is void with descretion of the auction.
18. All sales must be cleared through the auction office. Sales on premises not cleared through office will result in the termination of both buyers and seller's auction privileges.
19. "Title Delayed" Sales Seller should announce title delay at the time of sale and deliver to the auction a re-assignable title within a reasonable time period. NOTE TO BUYERS: Do not sell or spend any money on "Title Delayed" vehicles until you receive the title. The buyer and seller agree that South Alabama Auto Auction will not be responsible for any expenses for returning "Title Delayed" vehicles.
20. South Alabama Auto Auction does not guarantee the year of vehicle manufacture.
21. All vehicles left at the Auction are stored at the owner's risk. Vehicles are left on auction premises at owner's request and risk. The Auction will not be held responsible for loss or damage, even though the keys and vehicle may be placed in the Auction's custody. We are not responsible for theft or damage of any kind before, during or after the sale.
22. Buyer and seller agree to hold South Alabama Auto Auction harmless from any and all litigation that may arise from transactions executed through South Alabama Auto Auction. Should the auction be named in a suit, the buyer and/or seller agree to pay any and all attorney fees and court costs South Alabama Auto Auction incurs from defending itself.
23. By registering a vehicle for sale, seller agrees to the above policies.
24. By bidding on a vehicle, buyer agrees to the above policies.
---"AS IS" SOLD WITH NO ARBITRATION, ALL VEHICLES $1000.00 or less are automatically "AS IS" #8
Yellow Light ----"CAUTION" Seller must announce any items subject to arbitration. Buyer cannot turn down any Vehicle for announced conditions.
GREEN LIGHT-"RIDE & DRIVE" Seller declares the vehicle mechanically sound as described in Policy #9
BLUE LIGHT-- "TITLE DELAYED"- Refer to policy #19
BUYER AND SELLER FEES ARE SUBJECT TO CHANGE WITHOUT NOTICE
