All dealers must be licensed in their
state and registered at this auction before doing business.

All Public Customers must be registered
prior to doing any business.

All Public Customers must have a valid
drivers license.

All Titles submitted by seller must be
in sellers name and completed. Foreign titles are not acceptable.

Seller should announce that the Title is
not present at the sale "No Title" (blue light) at the auction block.

All vehicles with a Salvaged Title or
Previous Salvaged title must be announced.
-
All Public Customers must submit a clear
and valid title to the office for review before they will allowed to consign a
vehicle with the auction.

Titles and supporting documents with
corrections, erasures, deletions or alterations are not acceptable.

Buyer is responsible for verifying
serial number, model year and mileage reading on all purchases at time of
sale. No vehicle will be offered for sale without serial number plate or
proper verification. Seller is responsible to ensure a vehicle is properly
offered for sale at the block.

The Auction will not be responsible for
administrative errors. It is the buyer's obligation to watch lights and listen
to "Announced Conditions".

All police vehicles, taxi cabs,
municipal or government vehicles, fire damaged vehicles, flood damaged
vehicles, clips, salvage vehicles, reconstructed vehicles, kit cars,
motorcycles, boats and trailers must be sold "As Is" under red light and
announced as such.

Vehicles selling for $1,000.00 or less
become "As Is" and are not subject to arbitration for any reason.

The Auction does not guarantee any
warranty, service policy or mileage.

The Auction does not guarantee the model
year of any house trailer, motor home, boat, boat motor, antique, truck, dune
buggy, kit car, or motorcycle. Seller is responsible for verifying the model
year of the vehicle being sold. The Auction will not become involved in any
subsequent disputes regarding model year. Verification of the year, make, and
model is the responsibility of the seller.

"If" sales will be binding to the Buyer
through 12:00pm Noon the following business day of the sale when purchased. In
the event the auction cannot reach the Seller, the "If" sale stands at the
Buyers option till contact can be made with the Seller.

Vehicles are left on auction premises at
owner's request and risk. The Auction will not be held responsible for loss or
damage, even though the keys and vehicle may be placed in the Auction's
custody.

Adjustments, rejections, or arbitrations
must be handled on Sale Night. The Next Day Is Too Late!

Auction policies are subject to change
without notice.
- Buyer Will give a non refundable deposit of
$200.00 dollars to lane cleck for each vehicle that the buyer is the winning bidder of.
Light System
The auction has a
customized light system to describe the condition or announcements related to
the vehicle being purchased. The light
system is as follows:

Green
Light - "Drive"
this signals that the vehicle falls under policies that the vehicles motor and transmission is in reasonable condition giving its age, condition, mileage,
with yellow light exceptions for specific
announcements made prior to sale. All discretion is given to arbitrator.

Yellow
Light
-
"Caution/Listen" this light is an indication to the buyer that the seller has
made announcements that limit this vehicle from being arbitrated.

Red Light
- "As Is" this light indicates that vehicles under $1000.00
are not eligible for arbitration. No Exceptions!
·
Blue
Light -"No Title"
Assignable title not present at time of sale. All sales are subject to no title present.
The
seller
understands that the sale lights are a prerequisite statement for vehicle
conditions, and is responsible for ensuring
that their vehicles sell under the correct light.
The
buyer
is also responsible for
listening to announcements
related to vehicle and to understand the sale lights which identify sale
conditions.
Arbitratable
Conditions
“AS IS” vehicles sold under red
light
The following conditions
represent an “AS IS” sale and are not subject to arbitration for any reason,
except odometer discrepancies, frame/unibody and mandatory announcements in
previous section.
1.
All vehicles that are sold under $1000.00.
2.
All miscellaneous items
such as boats, campers, taxi’s, motorcycles, dune buggies, trailers, jet skis,
antique cars, snowmobiles, these items are exempt from arbitration for frame/unibody
damage, mileage/hours and year model.
3.
All off the block sales are sold
“AS-IS”, it is buyers responsibility to inspect vehicles.
4.
All vehicles for $10,000.00 or less are exempt from frame/unibody
arbitration.
5.
All vehicles sold at In-Op sale
are sold AS-IS, no exceptions.
6.
Auction does not guarantee miles
on vehicles that are exempt regardless of what seller announces.
7.
Cars 10 years
or older are exempt. All vehicles that are Exempt are TMU. The True mileage is
not known on Exempt vehicles. TMU does not have to be announced on Exempt
vehicles. The state of Alabama does not recognize miles on cars 10 years or
older.
Title Policy
This auction acts as a designated agent for buyers that are residents of the state Alabama. It is our responsibility to process your title information to the state with electronic title application program required by the state. Titles of vehicles that are sold at auction are clear of all liens.
Late titles:
Buyer is cautioned not to
spend any money on unit (you will not be reimbursed) and not to put excessive
miles on unit, not to damage unit and not to sell unit until title is received.
Special arrangements must be made with
Auction before unit is returned. The Buyer must have prior approval from Auction
management to return any unit to Auction. The Seller is responsible for all
Auction fees due on transaction.
Seller Responsibilities
1.
All conditions, mileage discrepancies, and known defects are fully
disclosed. All insurance company information such as total loss, flood damage,
theft, collision and government title.
2.
Seller has clear and valid title.
3.
All Gray Market vehicles must be announced.
4.
Odometer Status- Actual Miles, Exempt, TMU, replaced, Salvage History,
Theft Recovery, Lemon law buybacks, donated charity, former taxis, livery,
municipal and government vehicles.
Buyer Responsibilities
1.
Buyers should inspect vehicle fully before purchase and verify seller’s
disclosures. The VIN, year, make, model, mileage and odometer must be checked
before leaving.
2.
The auction is not responsible for administrative errors. It is buyer’s
responsibility to listen for announced conditions, watch for lights and sign bill of sale accordingly.
3.
Buyer will follow Auctioneers price, any discrepancies should be
addressed at the time before the auctioneer says “SOLD”, not following the sale.
Items written in vehicles by the seller are a representation and are subject to
arbitration.
4.
Buyer will pay bid price plus buyers fee as posted through out auction.
Buyer also guarantees sufficient funds, draft or floor plan. Sellers check must
be printed to match dealer’s license and auction registration.
5.
Buyer agrees that if in the rare event the vehicle is returned to auction it is in the same
condition or better when purchased. Buyer may be charged for damage, or
excessive mileage which will be determined by the auction.
Gray Market Vehicles
No Gray Market
vehicles other than vehicles made in North America for Canadian use that are
converted to U.S conditions can be sold. The vehicle must be in conformance with
all federal safety standards. Seller must also disclaim that vehicle is a
Canadian vehicle at time of registration and announced on block. Vehicle must
have valid title.
Business Policies
The auction promotes these policies to ensure that all business is fair to both
buyers and sellers. If the auction
feels that a business transaction is unethical it may exercise the right to the terminate the transaction.
The auction does not
guarantee or get involved with any warranty coverage including factory or dealer
warranty on vehicles sold at auction.
The auction does not
guarantee that information on Auto Check, Carfax, etc and will not arbitrate
based solely on this information.
All arbitration issues
should be discussed no less than 1 hour after the sale, and at this time all
concerns need to be addressed in initial claim.
Auction is not responsible
for loss or damages to any vehicles left on Auction Premises at owners request
and risk, Auction has right to tow/impound vehicle if left on auction property for
more than 1 week.
